Gone are the days when a site owner could refuse to recognise a Residents Association.
The 2006 Implied Terms added to the Mobile Homes Act 1983 (as amended) Schedule 1, Part 3, Paragraph 28 which became law on 1st October 2006 now gives Residents Associations who have more than 50% of the home owning occupiers in their association, the right to ask the site owner to recognise their QUALIFYING ASSOCIATION.
Only owner occupied homes qualify in the count. Empty or rented properties do not count. Homes occupied by site owners, their relatives, agents or employees do not count either.
