Pitch Fee Review

Clauses 16 to 25A of the Implied Terms regulate how and when a pitch fee review can take place.

The Review Date: is the date on which your pitch fee is increased (or decreased) annually.

At least 28 days notice must be given to you regarding the Site Owners 'proposed' increase (or decrease) before the review date.

Site Owners can only use the RPI available immediately prior to the 28 day notice being sent out:
  • OCTOBER FOR JANUARY
  • NOVEMBER FOR FEBRUARY
  • DECEMBER FOR MARCH
  • JANUARY FOR APRIL
  • FEBRUARY FOR MAY
  • MARCH FOR JUNE
  • APRIL FOR JULY
  • MAY FOR AUGUST
  • JUNE FOR SEPTEMBER
  • JULY FOR OCTOBER
  • AUGUST FOR NOVEMBER
  • SEPTEMBER FOR DECEMBER
Figures are issued monthly by the Statistical Office around the 18th of the month following which allows time for 28 days notice to be given before payment is due.

The review has to be laid out in a manner similar to the [(Pitch Fee) (Prescribed Form) (England) Regulations)] SI2013/1505


The review is not valid unless the information prescribed in that document and includes their name and address.

Any change in the pitch fee can only take place if you agree, and is payable from the review date.

If you do not agree, you must write (see Clause 18. (1) (a) (iii) which states "to which the majority of occupiers must have not agreed in writing"

If there has not been a previous review date, it cannot be reviewed until 12 months from the commencement date on your Written Statement.
